approved by Congress including implementation timelines and compliance related mandates.
Marilyn is an attorney who specializes in employee benefits and insurance corporate and regulatory law. She focuses her
practice on advising employers, health plans, and consults on compliance with federal and state employee benefit and insurance laws and regulations.
Marilyn is a frequent lecturer to human resources and employee professionals on new developments in the law. Health Care Reform Update #1
This
link will open an update on the new Health Care Reform law known as the Patient Protection and Affordable Care Act of 2010. Many of the Immediate Changes (within 2010) are scheduled to take effect by October 1, 2010. The provisions that will apply to Employer Provided Coverage within
this year are:
- No Pre-Existing Exclusion for Children
- Extended Dependent Eligibility to Age 26
- Small Business (25 or fewer employee) Tax Credit for offering Qualifying Employer Groups
- Coverage for Preventive Services will be Mandated with no Cost-Sharing Requirements
- Nondiscrimination Rules for Fully Insured Plans to ensure that the Plan is not Favorable to Highly Compensated Employees
- No Lifetime Limits on Coverage
- Improved Appeals Process for Claim Denials with a Requirement for Notice to be in the Language of the Participant
Non-Group Insurance Related Changes This Year
- Rebate of $250 to all Medicare Part D Enrollees who enter the “Donut Hole”
- Prohibit Rescission of coverage by health insurance carriers for valid claims
- Set up Temporary High Risk Poll for Individuals who were Declined Individual Coverage due to Pre-Existing Conditions
Key Provisions for 2011
- Health Insurance Issuers must disclose to participants how much of premium dollars spent on health care.
- Employers will be required to disclose the value of health coverage provided to each employee on their W-2
- Over the counter medication without a prescription will no longer be eligible for reimbursement under the FSA, HSA or HRA arrangements
- Simple Cafeteria Plans will be created for small businesses to provide tax-free benefits to employees.

Bechara, Chairman of MCS, the GPIS offices will be relocating their operations to a new MCS office in Glendale. Fritz Mutter, GPIS founder, has accepted the position of Managing Partner of MCS’s Los Angeles operations.
